If you went to a spanking new Doctor and he refused to treat you because you own HIV, what would you do?

I did a change of Doctor/Provider next to my HMO Insurance. I have several medical issues that enjoy been on going and two which needed on the spot attention so I put it all surrounded by writing. On May 10th, 2007 I arrived on time and hand him three pages-the first listed my instant medical needs which have three issues the second one being severe anguish in my upper back/lower nouns area and misery that radiated down my departed arm. As he read, he turned to the second page, saw that I am HIV+ & he then freaked out. He told me I needed a specialist and that I should christen my insurance company and get a specialist-he next handed me my co-payment support. I called my insurance company and they verified my story by calling the doctor what he did but they refuse to let me regulation providers until June 1st. The pain get so bad that I scream into a pillow-3 times during 1 day. I go to Emergency two times before they get the pain below control. I now own lost feeling within my left arm. Do I sue and for how much?

Jewish Attorney--from the biggest town near you---and I'm not kidding---as a PROVIDER for that HMO insurance-- he reasonably CANNOT REFUSE treatment---and he did-- your lawyer will know how to sue the doctor as well as the HMO because they should've referred you without hesitation to another physician for your illnesses. And don't laugh in the region of the Jewish part---I have found that they spawn the best attorneys because they are so "tuned" into the monetary value. Also kind sure your attorney is from out of the area--you do not want a lawyer who plays golf next to the doc you're trying to sue (that happened to me by the way) so find one from the biggest metropolis near you--hopefully, NYC, Chicago, Philadelphia, Boston..

Good luck to you, I hope everything works out for you and I am sorry that you be treated so inhumanely---what a world we live in------by the way----get a large notebook i.e. bound---you can't rip the pages out---document everything that happen starting with hours of daylight 1 and list the name of the people and the dates---and also document your symptoms and which dates how long you have the pains, who you called, who you talk to and gave you no help out, who you saw in the ER capture the ER notes, etc..you attain the drift---if you start the leg work for the legal endeavour BEFORE you see the attorney- you will have more to show him than only telling him things from your memory---I don't know going on for yours, but when I'm upset I can barely remember MY mark...good luck....I hope you catch millions....and if the attorney doesn't bring up the HMO suit-- YOU bring it up...you are supposed to have continued aspect care---they are liable for not providing such.

You could spend your spirit fighting. I would spend my force finding a doctor that could treat me and getting back on track beside your health. Suing will a short time ago lead to more stress and this is not apt for someone with an immune difficiency disease.

Also, it does nouns like you enjoy a herniated cervical disk or bulging/swollen disks in your neck - you will involve a specialist. That pain that radiate and numbness can be helped next to steriods but I am uncertain if you can lift them with adjectives of the other medicines you are probably taking.

First of all, this doctor be way out of stripe. If he wasn't qualified to treat you, he should have told you that. Then he should've given you a referral to another doctor or specialist. I would contact a legal representative. It is very unfair for a doctor to not treat a patient. You be also discriminated against. I would also file a complaint next to the American Medical Association and the Medical Board.

before you do anything similar to suring, you really should call your insurance provider and ask them what you should do here type of situation.

I doubt you would know how to sue successfully. In a non-emergency situation, a physician has the right to disallow to treat someone that has a condition or sickness that it out of his/her scope of practice. The doctor is right...you would stipulation to be under the diligence of an infectious disease specialist. While there are frequent doctors who are cross trained in different specialties, there are others who enjoy just one and will not cross the flash between one area of practice to another. There are masses reasons for this and one is that they may not be board certified surrounded by a certain nouns and run the risk of being sued for malpractice if they be to practice in that picky field.

It sounds to me that this physician be not a specialist in treating HIV and did not have a feeling comfortable doing so. For instance, you would not have an orthopedist treat a heart condition. The orthopedist would dispatch you to a cardiologist. See my point?

I don't feel this physician be out of line. Well...he might own been but he did the right piece in sending you to a specialist. If you consistency that he was, contact the medical board within the state where you live and see what you would call for to do. You could file a complaint but most probable this physician would defend himself by maxim he did not have the training to treat a being who is HIV positive. That would be a legitimate and reasonable response. I'm not trying to defend this physician. I'm only just trying to explain what seemed to enjoy happened.
