Can I sue the NHS?

I had a C-Section 3 weeks ago and they told me that my external stitches would disolve during the next days. Now they hold told me that my suture is not disolvable and they will make a small incison to be able to find and remove my suture. If my midwife wouldn't enjoy contacted to the hospital it would have been inside me for a long time and probably cause me an infection. What should I do?

Yes you can sue, they would have insurance but you probably won't win your claim. Even if you did hypothetically, what sympathetic of damages are you going to get? 'would have cause you an infection' or 'DID cause you an infection'? Have you had any RECOGNISED psychiatric illnesses as a result? I doubt it. You'd inevitability professional medical evidence to support your claim. If it is a genuine claim then this shouldn't be a problem.

Yes, it is medical negligence, and it isn't unbelievably nice, but the courts will look very sceptically at someone a)sueing the NHS in this scenario and b)laugh you out the building if you don't own any symptoms.

What would an award of damages be based on for a start? How would a judge attribute a amount to your claim? It's easy to claim damages for a wrecked car for instance - it would be the flea market value of the vehicle written off. How would you put a amount on it?

Morally, would you want to sue an organisation that has scarce and misused resources anyway? How would you feel if the subsequent time you needed treatment they were short by an amount that you'd been awarded?
