Worker Compensation Refusing to lend a hand me..?
My manager at work at me do a task that I told him multiple times that I would not know how to do.
This object is about 15ft soaring, I am 5'. He wanted me to scrub a years worth of muck and dust and buildup off of this using Lemon Quat and unbelievably cheap paper towels.
I grabbed one of our step ladder to try and complete the task as best as possible. The Manager literally Nagged me to complete it right that second "Have you done that yet, stir do it, do it " He told me to exceed my limits to get it done.
While stretching as best as I could the step stepladder slipped out from under me, causing me to topography completely on my ankle then fall put a bet on onto the refrigerator.
My ankle was seriously injured.
I was out of work for nearly two weeks, but workers compensation will not pay for the second week at all because I have received note from doctors that I could return to work with restrictions. Just resembling the first week he said it was illegal to right to be heard I couldn't return to work when workers comp was involved.
Answer:
I Cannot Believe This Just Happened!?
HIFirst of all I know you are NOT going to approaching what I have to say, but-you a moment ago dont understand how workmens comp works. and NO you case is NOT closed.YET...
THEY CANNOT MAKE A CLAIM OPEN AND SHUT SO FAST
1.Anytime someone get injured at work, You need to be off work for a consecutive 6 days - since the payment starts., then they whip the 7th day and so on.
..You do not get compensated the 6 days before that and you only seize 66 2/3 % of your wages.
So why did the Dr release you - or did he just say you can turn back if you want? What restrictions?
I think if I be you, I would return the Dr, you cannot just get a secont view and expect comp to pay for it - after you have gone to one dr, you must convey the claims examiner that you are having problems to go to a specialist.
What workmen's comp never tell you is your rights or explain what is going on. JUST because he said you can return, Did he actually release you and have you be there yet- if you are having alot of trouble, DO NOT GO BACK TO WORK, call for and say your ankle is not OK and you are returning to the dr. and payments will continue.
If they administer you any kind of hassle - GET A LAWYER. WC is responsible for that injury for the rest of your LIFE - even 5 yrs down the line - if you involve surgery- they must pay. but it must pertain to original injury
IF you be 'seriously injured" you sure heal fast--
Depending on job, within really is no such thing as 'return to work with restrictions, it funds accomodations-- and if they did not accomodate you right away,If you do go back to work, and cannot fiddle with it, then payment process starts adjectives over
Comp is responsible to pay you.but truthfully if you havent been put money on, you are better off staying home!'
Look, I dont know what state you are in, but most of this is pretty cut and dry state to state and I WANT TO HELP YOU - newly know that the pay you received is all you find. HOWEVER- there is sooo much more to this-- i just hope you havent be back to work!
the reason why I know this information is because I hold been on comp for 20 yrs. i have 'been within, did that and the battle continues...
I think nearby is something to be said about your Manager, He was be wrong!, but why was there no-one holding the stepladder ...
Let's talk. I am not here to make you be aware of bad- just to help!
Am I considered a crack go before?
How are you doing very soon? Don't know why the doctor would release you back to work if you have a serious injury. Maybe you inevitability to get a second option from a different doctor. You call for to get an Attorney who deals lone in Workers Compensation. If you have a serious injury to be precise causing you to not to be able to work you will entail an attorney. If the attorney thinks you have a baggage, they will take it and not charge any money up front. Good Luck. How masses hours do u sleep every dark?
I agree if you had a doctor's file saying you were effective of doing "light duty" than you have the responsibility to show up for work and do tasks that you can do. That is basically the way it works. However, why come here and seek comfort, call and set up a meeting beside a work comp attorney, most will have a free initial consultation and get the facts for you state and see if you enjoy a case.If your doctor said you could return to work with restrictions, consequently workman's comp considers the case closed and you get no more benefits.
